Here is a pic of the bolt firing pin retaining stud on my 2009 model 39a. Marlin added the retaining stud in 1988. As the picture indicates, the outer edge of the stud is just enough to keep the firing pin from being removed. It's main purpose is to keep the pin from marring the top of the reciever when cycling the action.The bolt face is recessed to fit the cartridge or case head, about 1/16 of an inch. The firing pin protrudes to a point level with the case surround or about 1/16 inch. So it is past the case recess and extends to a point even with the end of the bolt. The firing pin will stick out the rear of the bolt for the hammer to hit if there is a round in the chamber to push the pin back. It has nothing to do with the rifle being pointed down unless the end of the firing pin is broken off so the cartridge can't push it back. I have 18 39A Marlin's and there is not any of mine that won't fire pointed down.

Recently recieved my 1897 Marlin 22 back from the gunsmith , had it relined and a new 39 bolt and firing pin from Dick's Gun shop also. After 20 rounds fired it wouldn't extract. I looked and saw there was a burr at the top entrance of the chamber, where the firing pin hits.The ejection hang up happens pretty randomly. I never try to eject the shell in a particular direction, however sometimes I lever very quickly, and sometimes slower yet deliberate. It happens in both conditions, as well as those in between. I replaced the broken finger lever spring, replaced a missing sight ramp screw, put in a Wolfe reduced power hammer spring, mounted a Lyman 17a globe front sight, and cleaned and lubed the bore and action.
